Effective date: July 27, 2026. These Terms form an agreement between the customer (“Client,” “you”) and CertLev, operating as CertLev (“CertLev,” “we,” “us”). By creating an order, accepting these Terms, or using paid services, you confirm that you are at least 18, have legal capacity, and are authorized to act for the named customer.
1. Service and order structure
CertLev provides custom website design, development, configuration, project management and related deliverables. The package selected at order time, saved package snapshot, accepted project brief, written change orders, and these Terms together define the agreement. Marketing pages describe starting service levels; the saved order record controls for that project.
2. Scope and change orders
Only work expressly included in the saved scope is included. Additional pages, redesign after approval, new features, integrations, data migration, content production, regulated-industry requirements, third-party troubleshooting, or changed business instructions may require a separate quote, schedule and acceptance. CertLev may decline instructions that are unlawful, unsafe, technically unreasonable, or outside its service capabilities.
3. Client responsibilities
You must provide timely, accurate and complete instructions, content, decisions, access and approvals. You represent that you have all rights and permissions needed for logos, trademarks, text, images, video, data, software, accounts and other supplied materials. You are responsible for the legality, accuracy and final approval of your business claims, prices, policies, products, accessibility obligations, taxes, licensing, regulated activity, privacy practices and production data.
4. Payment
Prices are shown in the listed currency and do not include taxes, third-party fees, subscriptions, licenses, hosting or domain costs unless expressly included. Payment is handled through the configured third-party payment provider. CertLev does not collect card numbers or bank-login credentials on this site. Work ordinarily begins only after payment is verified and readiness conditions are satisfied. Starting-price and custom projects may require an approved final scope or additional payment.
5. Timing
Delivery windows are good-faith estimates, not guaranteed dates, unless a signed custom agreement states otherwise. Estimates begin after required payment, accepted scope, usable content, required access, approvals, and any applicable consumer service-start period. Client delay, third-party outages, platform review, scope changes, force majeure and unforeseen technical conditions extend timing reasonably.
6. Revisions
A revision list is one organized round of requested changes submitted together in the portal. The listed limit applies to submitted rounds, not the number of individual notes. Revisions must relate to the approved scope. CertLev may classify a request as out of scope and offer a change order. “Unlimited” revision lists, where offered, apply only during active development, one organized list at a time, within approved scope, and subject to reasonable use and project progress.
7. Review, acceptance and correction
You must review deliverables and report reproducible material nonconformities promptly. Delivery, deployment, approval, material use, or failure to identify a material scope deviation within 10 business days after final delivery may constitute acceptance to the extent permitted by law. CertLev should receive a reasonable opportunity to correct a covered nonconformity.
8. Intellectual property
After full payment, CertLev assigns to the Client the transferable rights CertLev owns in the final client-specific deliverables, excluding CertLev’s pre-existing materials, reusable tools, generalized code, processes, know-how, templates and development utilities. Open-source software, fonts, stock assets, platforms and third-party components remain governed by their own licenses. Unless prohibited in writing for legitimate confidentiality reasons, CertLev may identify the Client and display nonconfidential public-facing work in its portfolio after public launch.
9. Credentials, hosting and security
You must be authorized to provide every account and credential. Use temporary, role-limited access where available and rotate credentials after handoff. No internet service is completely secure. CertLev does not warrant that a website will be immune from every vulnerability, attack, outage or third-party change. Hosting, backups, monitoring, updates and incident response are not included after handoff unless separately contracted.
10. Third-party services
Domains, hosting, content systems, payment processors, booking tools, plugins, APIs and other third-party services are controlled by their providers. Their terms, pricing, availability, reviews, data practices and technical changes apply. CertLev is not responsible for a third party’s acts or continued compatibility, but will perform agreed integration work with reasonable care.
11. Prohibited use
You may not use the service for unlawful, fraudulent, infringing, deceptive, malicious, exploitative or unauthorized activity; malware; phishing; credential theft; spam; evasion of security controls; unlawful surveillance; or collection of personal data without proper authority. Regulated or high-risk projects require advance disclosure and may be declined.
12. Suspension and termination
CertLev may pause work for nonpayment, missing decisions or access, unsafe credentials, prohibited activity, material breach, or a project that cannot reasonably proceed. Either party may terminate as allowed by the Cancellation & Refund Policy and mandatory law. On termination, fees, earned work, third-party commitments, data handling and accrued rights remain governed by the agreement.
13. Warranties and disclaimers
CertLev warrants that it will perform the agreed services with reasonable professional care. Except for express written commitments and rights that cannot be waived, services are provided without promises of a particular revenue, ranking, traffic level, conversion rate, legal result, regulatory approval, uninterrupted operation or compatibility with future third-party changes.
14. Liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, exemplary or consequential loss, lost profits, lost business, or lost data arising from the agreement. CertLev’s aggregate liability for a claim will not exceed the amount paid for the specific project giving rise to the claim, except where law prohibits that limitation, or for fraud, willful misconduct, infringement indemnity expressly assumed, or other liability that cannot be limited.
15. Indemnity
You will defend and indemnify CertLev against third-party claims arising from materials, data, business claims, products, instructions or systems you provide or require, except to the extent caused by CertLev’s breach or misconduct. CertLev will promptly notify you and permit reasonable control of the defense.
16. Governing law and disputes
Subject to mandatory consumer rights, the agreement is governed by the laws of New York, United States, without regard to conflict rules. Before filing a claim, the parties will try in good faith for 30 days to resolve it through written notice. Courts with lawful jurisdiction in the operating entity’s county and state may hear disputes unless mandatory law provides another forum. No class-action waiver or arbitration requirement is imposed by this template.
17. International and consumer rights
Nothing in these Terms removes a non-waivable consumer, privacy, accessibility, warranty, cancellation or other right. If a provision conflicts with mandatory local law, it is modified only to the minimum extent necessary, and the remainder continues. CertLev may restrict sales where payment, sanctions, export, tax or legal requirements cannot reasonably be satisfied.
18. Changes and records
The version accepted for an order remains recorded with that order. We may update future versions for later orders. Electronic acceptance, timestamps and portal records may be used as evidence of the transaction. Notices may be sent through the portal or to the email associated with the account.
